Fox 2 News aired one side of a story. A criminal charge was filed. Here are the court documents, signed contracts, and official records that tell what really happened.
The Accusation
In 2015, Fox 2 News reporter Rob Wolcheck aired a "Hall of Shame" segment featuring Andrew Johnson, who appeared on camera and stated that Robert Anderson "stole his money." That broadcast caused immediate, serious harm: Robert Anderson received death threats, his business was damaged, and his reputation in the trucking community was destroyed.
What Andrew Johnson told Fox 2
Johnson claimed Robert Anderson took his money without delivering a truck. He implied the transaction was fraudulent and that he was a victim of theft.
What the signed documents actually show
Andrew Johnson signed a Non-Cancelable, Non-Refundable lease agreement with North South Leasing on January 7, 2015. The contract explicitly states that all deposits and administration fees are NONREFUNDABLE. Johnson never delivered the 12 required documents needed to fund the lease. No truck could be released until funding was complete — Johnson failed to fulfill his obligations under the contract.
Rob Wolcheck presented Johnson's one-sided account without obtaining the signed lease documents or contacting North South Leasing for comment. The broadcast never showed that Johnson had signed a contract explicitly marked "Non-Cancelable, Non-Refundable" with fees clearly labeled Nonrefundable in bold text — before any money changed hands.
Robert Anderson subsequently filed a civil lawsuit in Macomb County Circuit Court (Case No. 2018-000254-CZ) naming Fox 2 News, Rob Wolcheck, Andrew Johnson, and others as defendants.
The Contract
On January 7, 2015, Andrew Johnson signed a lease approval with North South Leasing for a 2005 Freightliner Classic XL. Every page of the document makes the nonrefundable nature of the fees unmistakably clear.
"All deposits are nonrefundable. At time of pickup we will also need a copy of insurance for full value of equipment with NORTH SOUTH LEASING as ADDITIONALLY INSURED and LOSS PAYEE."— Lease Approval document, signed by Andrew Johnson, January 7, 2015
The lease contract was clear: no truck would be released until North South Leasing received and approved all of the following. Johnson failed to provide them.
| # | Required Item |
|---|---|
| 1 | Year-to-date pay stub |
| 2 | Three months of bank statements |
| 3 | Hauling contract with phone number to verify employment |
| 4 | Copy of driver's license (front and back) |
| 5 | Signed original documents with thumb print |
| 6 | Certified funds for advance payments (Cashiers Check or Money Order) |
| 7 | Proof of Business (DBA, LLC, Schedule C, etc.) |
| 8 | Six personal references not related to the applicant (with docs) |
| 9 | Copy of latest two years of personal and business taxes |
| 10 | Proof of residency (copy of utility bill in applicant's name) |
| 11 | Copy of last month's cell phone bill (all pages) |
| 12 | Completed ACH form with original voided check from business checking account |
The Bottom Line
A truck lease requires documentation, insurance, and certified funds — the same as any commercial vehicle financing. The contract Johnson signed explicitly stated fees were nonrefundable. When Johnson did not deliver the required documents, the lease could not be funded. No truck was ever released. No money was "stolen."
The Criminal Case
Prosecutor Sian G. Hengeveld signed the Motion to Dismiss stating:
"Dismd w/out prejudice b/c I cannot prove elements."
Judge Sebastian Lucido signed the Order of Acquittal/Dismissal.
A criminal charge of Uttering & Publishing was filed in 2013 (Case No. 13-1613SC). Robert Anderson testified in his own defense. After hearing his testimony, the prosecutor — not a judge, not a jury — made the determination that she could not prove the elements of the crime. The case was dismissed.
The dismissal was signed on July 24, 2013. A final Order of Acquittal/Dismissal was entered by Judge Sebastian Lucido on July 14, 2015.
Official Court Record — Motion to Dismiss
Signed by Prosecutor Sian G. Hengeveld:
"Dismissed without prejudice because I cannot prove elements."
This is not a plea deal, a technicality, or a dismissal on procedural grounds. The prosecutor who brought the charge stated in writing that the evidence was not sufficient to prove the crime. Robert Anderson testified and the case collapsed.
| Detail | Court Record |
|---|---|
| Case Number | 13-1613SC |
| Charge | Uttering & Publishing |
| Motion to Dismiss Filed | July 24, 2013 |
| Reason for Dismissal | "Plaintiff cannot prove elements" |
| Who Signed the Dismissal | Prosecutor Sian G. Hengeveld |
| Final Order of Dismissal | July 14, 2015 — Judge Sebastian Lucido |
| Result | DISMISSED — Order of Acquittal/Dismissal |
The Fox 2 broadcast aired after this dismissal. Viewers were not told that the criminal case had already been dropped because the prosecutor could not prove the charge.

In Robert Anderson's Own Words
Robert Anderson's Statement
The following is my personal account of what happened, written in my own words.
Mr. Andrew Johnson appeared on Fox 2 News with Rob Wolcheck's "Hall of Shame" segment and made misleading statements, claiming that I — Robert Anderson — "STOLE HIS MONEY." Those words were broadcast on television to the entire Metro Detroit area.
What Fox 2 never showed was the signed lease agreement that Andrew Johnson himself signed on January 7, 2015. That document — in plain black and white — lists the Administration Fee and GPS Fee as NONREFUNDABLE. The lease itself is titled "Non-Cancelable, Non-Refundable." Johnson signed it. He acknowledged the terms. He was given a list of 12 documents that had to be delivered before the truck could be released. He never delivered those documents. Without the required paperwork, the lease could not be funded. No truck was ever released.
No money was stolen. The fees Johnson paid were contractually nonrefundable — the same as any nonrefundable deposit at any business. He knew this when he signed.
The consequences of that Fox 2 broadcast were immediate and severe. I began receiving death threats. My business was damaged. My reputation in the trucking community — a community I had worked in for years — was destroyed by a one-sided news segment that never contacted me for my side of the story, and never showed the documents that tell the full truth.
There was also a criminal case — Case No. 13-1613SC — filed against me. I testified. After I testified, the prosecutor herself, Sian G. Hengeveld, signed a Motion to Dismiss stating in her own handwriting that she "cannot prove elements." The case was dismissed. Judge Sebastian Lucido signed the final Order of Acquittal/Dismissal on July 14, 2015. I was not convicted. I was not found guilty. The case was thrown out because the evidence was not there.
This website exists so that anyone who saw the Fox 2 story can also see the documents, the court records, and the signed contracts — and decide for themselves. I built this site because I deserve the right to tell my side.
